TERMS & CONDITIONS
The client hereby acknowledges having been informed of the terms and conditions stated and described underneath. Booking confirmation implies full acceptance of the terms of the contract. The client accepts to produce proof of identity on booking, signature of the contract and upon entering the premises.
General conditions
Rental period
Rentals are accepted for a limited period stated on the contract. In general and unless otherwise settled in writing by both parties, arrival time must be from 2.00 to 7.00 P.M. and departure time from 9.00 to 12.00 A.M. No arrival after 7.00 P.M. will be dealt with. Rentals may be extended, subject to availability of the apartment and prior written agreement of Vacancy Ltd.
Inventory of fixtures
The apartments are rented furnished and fitted out (kitchen utensils, tableware) including linen (bedding and towels). An inventory stating items and condition is signed by both parties upon arrival and checked on departure.
Vacancy ltd reserves the right to request compensation for broken, cracked or otherwise damaged objects or pieces of furniture, as well as cleaning expenses for soiled blankets, mattresses or seat covers.
Number of guests
Rentals are accepted for a number of persons determined in the contract. The client commits himself to provide on booking the name of each occupant. Only such persons will be accepted in the apartment upon arrival. Babies (up to 2 years) will be accepted beyond capacity on condition that the customer provides his own bedding.
Pets (cats or small dogs only) are welcomed in most apartments (subject to owner limitations stated in the descriptive sheet) for a small inclusive fee and must be declared on booking. Any damage will be billed on departure.
Payment conditions
Booking before 30 days of arrival : 25% down payment on booking. Payment of the remaining balance 30 days before arrival.
Booking within 30 days of arrival : full payment on booking.
Rental becomes effective only after full payment has been recorded.
Payment modes
Major credit cards accepted. Checks are accepted providing they are received and cashed 30 days before the client's arrival. Bank transfers are also accepted providing that our account is credited 30 days before the client's arrival.
Commitments of the client
The client commits himself to :
1. Occupy the place in an ordinary and sociable fashion, without running within any business or industry or any professional activity of any kind, the tenant being aware that the rental has been accepted on a temporary basis, a condition without which the present contract would have no existence. He must conform to the provisions of the condominium by-laws, (if any, made available in the apartment).
2. Not disturb in any way the quietness of the neighborhood, in particular from 10.00 P.M. to 6.00 A.M
3. Occupy the apartment himself and not sublet, even for free, the rented premises provided for a fixed number of occupants, subject to immediate and full termination of the contact.
4. If damages, following negligence of improper use of the place and/or its equipments, were to be noted, the tenant would be held responsible and billed for the necessary repairs. All equipments are delivered in good working order except otherwise noticed on the inventory sheet and any complaint made beyond the first 48 hours of occupancy will not be taken into account. Repairs will then be billed to the client.
5. Avoid throwing in sink, tub, shower, toilet bowl, washbasin, or disposal and chute, objects that could clog or block drains or shafts: the tenant would be charged for any resulting repair needed to restore the equipment to normal operating conditions.
6. not hang laundry or linen on balcony, terrace or window or any common parts of the condominium.
7. not make any change to the place in terms of paint, wall-paper, furniture setting or decoration.
8. allow access to the place to Vacancy (following a request from the tenant or the owner) to have the necessary repairs done in view of keeping everything in working order or to read out the meters.
9. not request any rebate on the amount of the rent in case urgent repairs paid for by the owner or Vacancy would have to be made during his stay.
Vacancy ltd takes no responsibility for any inconvenience not depending or caused by the company such as gas, electricity, water or telephone cuts or elevator or interphone failures.
Commitments of Vacancy Ltd
- Deliver the apartment in good condition with all equipments operating satisfactorily.
- Deliver the services offered in the descriptive sheet at advertised prices.
- Make sure that the stay of the customer is spent in optimum conditions.
Tourist Tax
Rates do not include the tourist tax (a small fee per day and per person which depends on the location). Tourist tax will be calculated and paid on arrival according to local legal provisions.
Security deposit
- To guarantee the carrying out of the contract and cover the possible damages that could be caused to the rented property, the tenant will pay, as a security deposit, the amount indicated on the contract.
- The payment will be made by check issued to the order of Vacancy ltd.
- The security deposit will be refunded within 30 days maximum after the departure inventory. Amounts owed for repairs, if any, will be deducted from the security deposit.
Cancellation conditions
On account of the tenant :
The contract is cancelled if the full amount of the rental price is not paid within the period of time provided by the contract.
If the client's party exceeds the number of sleeping places indicated in the descriptive sheet of the property, the contract is cancelled.
On account of Vacancy ltd :
In the unlikely event that the booked property would no longer be available, Vacancy Ltd commits itself to offer an alternative accommodation in an equivalent place of comparable location. Should this solution not be accepted by the client, Vacancy Ltd will refund all amounts paid to the company, exclusive of any other form of compensation.
Revocation delay
In compliance with European directive n°97-7 passed on may 20th, 1997, the tenant is entitled to a 7 days delay of revocation starting either the day the contract is signed or the day he receives the booking confirmation from Vacancy ltd, whichever comes last.
Conditions of cancellation and civil liability
An insurance is proposed by Vacancy Ltd, at a cost of 2% of the full amount of the rental price, to cover cancellation fees and damages liability. Should the tenant not choose this solution, he commits himself to provide the company with a travel insurance certificate stating the risks covered and the corresponding amounts.
If cancellation occurs before 30 days from the arrival date, only the down payment is kept by the company. In all other cases, the full amount is due.
Interruption of stay
No refund will be made for an interruption of stay decided by the tenant.
Legal provisions
The present provisions and the contract between the client and Vacancy Ltd are subject to French legislation and exclusive jurisdiction of Parisian courts of justice.
Personal information
At booking time, the client will have to provide personal information and data for the needs of booking procedures. Vacancy Ltd commits itself to keeping the corresponding data in secured files and not distribute or share them with anyone for any purpose.
In compliance with the law n°78-17 dated January 6th, 1978, the client can access his file at any time for consultation or amendment./.
